you're going back to the disclaimer business? 

if there's a BSD variant chez http://www.opensource.org/licenses
which omits that clause, no problemo. What we can't afford
is to write our own variant.

but we may be chasing each others tails. The proposal is to 
use "http://www.opensource.org/licenses/BSD-2-Clause", isn't it?
