It seems there are 3 different views of licence.

1. licence as paragraph-like object

 >     <availability>
 >       <licence target="…">…blah blah .</licence>
 >    </availability>

2. licence as phrase-level object
 >     <availability>
 >       <p>Blah blah<licence target="…">….</licence></p>
 >    </availability>

3. licence as div-like object
> <availability>
>     <licence target="http://creativecommons.org/licenses/by-sa/3.0/">
>       <p>...</p>
>     </licence>
>     <licence target="http://www.gnu.org/licenses/fdl.html">
>       <p>...</p>
>       <p>...</p>
>     </licence>
> </availability>

Given that some licences insist you include a copy of the 
existing source's licence with the material, or similar, my 
preference for these is number 3.
